TERMS & CONDITIONS
of the Fribourg Touris Board's (Union fribourgeoise du Tourisme) competition
1. Participation in the competition is optional and free of charge.
2. The competition will take place exclusively online. It will run from 26.12.2024 at 12:00 am to 31.12.2024 at 11:59 pm (GMT+1) on fribourg.ch/en/spengler-cup. A draw will be held every day as part of the competition. Registration for the competition is online. The respective entry is only valid for the draw on the day in question. Participation in the daily prize draw is only possible between 00:00 and 23:59 on the day in question.
3. The winners will be drawn within 7 working days of the end of the entry period. Only the winners will be contacted by e-mail. If a winner cannot be contacted or does not contact the UFT within seven calendar days of being notified of the prize, the UFT has the right to draw another winner.
4. Participation is open to anyone aged 18 or over and permanently resident in Switzerland.
5. Prizes cannot be converted into cash.
6. One entry per person and per day is permitted. Any cheating will result in exclusion from the prize draw. The information requested must be complete and truthful. UFT employees and partners are excluded from the competition. Any recourse to legal action is excluded.
7. To the extent permitted by law, the UFT excludes all liability in connection with the competition it organises and the organisation and redemption of prizes. In particular, the UFT is not liable for technical failures of the competition page, including network server breakdowns or hardware faults, viruses, bugs, programming errors or other transmission errors beyond its control. By taking part in the competition organised by the UFT, you accept our privacy policy. 15) Winners will be chosen: (delete as applicable)
•Prizes are awarded based on the results achieved in the game (score). Winning criteria and periods of play are communicated within the game. If two players achieve exactly the same number of points, the decision is made by drawing lots.
•at random by software, from all entries received and verified by Promoter and or its agents.
•as a result of a popular vote conducted via social media sites as measured and recorded and verified by Promoter and or its agents.
•by an independent adjudicator or panel of judges appointed by the Promoter.

16) The winner will be notified by email and/or direct message on Twitter/Facebook and/or letter within 28 days of the closing date. If the winner cannot be contacted or do not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
17) The promoter will notify the winner when and where the prize can be collected / is delivered.
18) A liability of the game manufacturer, competition organizer and partner companies for incorrect information provided by the participants or technically caused errors in connection with the decision to win is excluded.
19) The winners assume responsibility for accepting the prize and bear all consequences of such acceptance. Any costs, taxes or other information incurred in connection with winning a prize shall be borne by the winners.
20) If the prize cannot be delivered to the winners within … months of notification by post, the prize will be forfeited without compensation.
21) Prizes are awarded by and/or partner companies. The prize is awarded after the closing date for participation. The competition organizer may replace the prizes with other equivalent prizes at any time. The prizes are not paid out in cash and cannot be exchanged. A waiver is possible. If a participant does not provide his or her address data at the request of and thus prevents shipment, he or she automatically forgoes the prize.
Data usage:
22) The winner agrees to the use of his/her name and image in any publicity material, as well as their entry. Any personal data relating to the winner or any other entrants will be used solely in accordance with current data protection legislation (see our Privacy Policy) and will not be disclosed to a third party without the entrant’s prior consent.
Liability:
23) The competition organizer reserves the right to shorten, extend, change or cancel the competition or parts of it without prior notice. It cannot be held liable for this and no compensation can be claimed from it.
24) The competition organizer cannot be held liable if participants cannot access the game and/or cannot participate in the competition due to technical or other problems - in particular due to network overload.
25) The competition organizer and the companies involved in the implementation of the competition draw the participants' attention to the special features and limits of the Internet and disclaim any liability for consequences which participants may suffer as a result of connecting to the Internet via partner websites.
Final provisions:
26) The competition organizer expressly reserves the right to adapt these conditions of participation at any time. No correspondence will be entered into regarding the competition. Legal action is excluded. Swiss law applies exclusively.
27) In the event of disputes concerning the interpretation and application of these conditions of participation, an amicable settlement will be sought. The place of jurisdiction for cases that cannot be settled amicably is (Zurich, Switzerland.), January 2024.
